Lovercase Typefaces

Typography Products refer to the typographic fonts, typefaces, and related materials, including but not limited to design files, documentation, and accompanying materials, provided by the licensor under this EULA. Licensor refers to the entity or individual that owns the intellectual property rights in the Typography Products and grants the license under this EULA. Licensee refers to the individual or entity accessing, downloading, or using the Typography Products under the terms of this EULA.

Subject to the terms and conditions of this EULA, the Licensor hereby grants the Licensee a non-exclusive, non-transferable license to access, download, and use the Typography Products for the Licensee's personal or commercial use in accordance with the restrictions set forth in this EULA. Desktop License: The Licensee may install and use the Typography Products on desktop computers or other similar devices solely for personal or commercial desktop applications, including print and digital content creation. Web License: The Licensee is granted the right to use the Typography Products for use on websites, web applications, and digital platforms, including embedding within HTML, CSS, or other web technologies. The Licensee may use the fonts for web-based user interfaces, online advertising, or web graphics, but may not sublicense or distribute the fonts as standalone files. App License: The Licensee is granted the right to embed the Typography Products in mobile, desktop, or web applications (Apps). The fonts may be used for display or UI/UX within an app but cannot be redistributed or resold as part of the app. Media License: The Licensee is granted the right to use the Typography Products in audio-visual media such as TV, film, streaming services, or any other broadcast or public media, including digital advertising or video production. Fonts may be used in titles, credits, and on-screen text in such media. Logo License: The Licensee is granted the right to use the Typography Products in the creation of logos, wordmarks, and brand identities for personal or commercial purposes. The Licensee acknowledges that this does not grant trademark rights to the Typography Products themselves, and the Licensor retains full ownership of the fonts. The Licensee may not claim exclusive rights to a typeface or prevent others from using the same typeface in different contexts. Trial License: The Licensee may only be use trial fonts for testing, mockups, or internal presentations and cannot be used in any final or public-facing projects, whether commercial or non-commercial. The licensee may not modify, distribute, or embed trial fonts in any product, application, platform, or media. Any unauthorised use of trial fonts beyond their intended purpose requires the purchase of an appropriate license. These files are provided in their complete form, including all glyphs, to allow realistic testing and contextual evaluation. We trust licensees to use them responsibly and in accordance with the terms of this agreement.

The Licensor retains all rights, title, and interest in and to the Typography Products, including any copyright, trademark, and other intellectual property rights therein. The Licensee shall not modify, reverse engineer, decompile, disassemble, or create derivative works based on the Typography Products without the prior written consent of the Licensor. The Licensee agrees not to remove or modify any copyright notices or proprietary legends appearing in the Typography Products.

The Licensee shall not distribute, sublicense, lease, rent, loan, or otherwise transfer the Typography Products to any third party without the express written permission of the Licensor. The Licensee shall not use the Typography Products in a manner that infringes upon the intellectual property rights of the Licensor or any third party. The Licensee shall not embed the Typography Products in software, hardware, or other products for distribution, sale, or public use without obtaining a separate license from the Licensor. The Licensee is strictly prohibited from using the Typography Products, in whole or in part, for the training, development, or enhancement of any artificial intelligence (AI) or machine learning (ML) models, including but not limited to generative AI, neural networks, and other data-driven systems. This includes uploading, sharing, or otherwise providing the Typography Products to any AI or ML platform, database, or service that processes typographic data for analysis, replication, or automated font generation. Any such unauthorized use shall constitute a material breach of this EULA.

The Licensor may provide support and maintenance for the Typography Products at its sole discretion, but is not obligated to do so. The Licensee acknowledges that the Licensor shall not be liable for any loss or damage arising out of or in connection with the Licensee's use or inability to use the Typography Products, including but not limited to any errors or defects in the Typography Products.

This EULA is effective upon the Licensee’s acceptance and shall remain in effect until terminated. The Licensor may terminate this EULA immediately without notice if the Licensee breaches any of the terms and conditions contained herein. Upon termination, the Licensee shall immediately cease all use of the Typography Products and delete or destroy any copies of the Typography Products in its possession or control.

The typography products are provided “as is” without warranties of any kind, whether express or implied. The licensor disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, in no event shall the licensor be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the typographic products, even if advised of the possibility of such damages.

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which the Licensor is located. Any dispute arising out of or in connection with this EULA shall be submitted to binding arbitration in accordance with the rules of the arbitration association in the jurisdiction of the Licensor.

This EULA constitutes the entire agreement between the Licensor and the Licensee with respect to the Typography Products and supersedes all prior or contemporaneous understandings or agreements, whether oral or written.
